How the period is counted
Section 12(1) of the Limitation Act excludes the day from which the period runs, so the period is added to that day. A 30-day appeal against an order of 10 October ends on 9 November.
Section 12(2) excludes the time taken to obtain a certified copy of the decree or order: from the day the copy is applied for to the day it is ready, both days included. Time spent before applying does not count, and an application made after the period expired gives no exclusion.
When the last day is a holiday
Under section 4, if the period expires on a day the court is closed, the filing may be made on the day it reopens. This free calculator treats Sundays as closed. Inside AdvocateFlow, each chamber adds its own High Court's holiday list and the reopening day is worked out automatically.
Delay beyond the period needs an application for condonation of delay under section 5, showing sufficient cause.
