The method

Loss of dependency = annual income, plus future prospects, less the deceased's personal expenses, multiplied by the multiplier for the deceased's age. The multipliers come from the table in Sarla Verma v. DTC (2009) 6 SCC 121: 18 up to age 25, falling to 5 above 65.

National Insurance Co. v. Pranay Sethi (2017) 16 SCC 680 added future prospects: for permanent employment, 50% below 40, 30% from 40 to 50 and 15% from 50 to 60; for the self-employed or those on fixed wages, 40%, 25% and 10%.

Deductions and conventional heads

Personal expenses are deducted at one-third where there are two or three dependants, one-fourth for four to six, one-fifth for more than six, and one-half for an unmarried deceased (Sarla Verma).

Pranay Sethi fixed loss of estate at ₹15,000, funeral expenses at ₹15,000 and consortium at ₹40,000, to be increased by 10% every three years. Magma General v. Nanu Ram (2018) held that consortium is payable to each eligible claimant: spouse, children and parents.
